Will or Living Trust?

Question:


I am asking for friend her husband of 46 has terminal cancer. They are wanting to know should they do will, living trust or what. They are buying a house and car; grown kids; few personal assests. They want to do asap before he is not able to any longer.

Answer:

Hi, of course I can't give individual legal advice, however
considering they apparently have few assets, I think a will would probably work fine. They should think about titling things jointly with rights of survivorship -- or possibly even moving some things into the wife's name solely if the medical expenses or qualifying for medicaid could be an issue. If they have concerns about that they should see an estate planning / medicaid attorney.
