I am co-trustee with one other person. Can I force the other trustee to resign? She is violating the terms of the trust, but it does not say anything in the trust about this kind of event.
I'm afraid if the trust does not address the issue than you may well have to go to court to force the other trustee to resign. Laws vary from state to state on this so you will want to talk to a local trust attorney.
