Should We Amend or Revoke Our Living Trust

If we already have a living trust and want to create a new, simplified living trust, is it best to revoke and start from scratch, or amend?


We have an A/B Living Trust we feel is too complicated for our needs. Our estate of about $1 million is equally divided between real/personal trust property and retirement assets in IRA's and annuities.

Good question. There's a pretty good answer to your question here:

amend or revoke living trust.

If you read that article you'll see the key issues are whether you have already funded your trust so that you have things already titled in it's name (in which case you may not want to revoke the trust) and also how complicated the changes are that you are making.
