renaming a trust after a death

by kenneth
(west virginia)

my father and mother have a living revocable trust that is titled in both their names. the trust is to become irrevocable at the demise of the first spouse.

is the trust to be retitled at this point, to reflect that it is now "irrevocable", or does the original title remain the same, with the understanding that it has become irrevocable?

the state is west virginia, if that matters.

good question for trust drafter
by:

Hi, I would doubt the trust would need to be retitled -- but I don't want to hazard a guess not being a West Virginia lawyer or seeing the trust.

And, actually whenever there is a major life event, like the death of a spouse, it's a good idea to talk to your attorney about how that event might impact on estate planning documents.

So, again, I'd say you should check with the attorney who drafted the trust.
