Medicaid Trust Question

My mother is currently on Medicaid. We are currently selling her house but the assets have to go into a Medicaid Trust. If we choose to cancel her Medicaid and keep her on Medicare, can she keep the sale of her assets?

Answer:
Hi: I'm not sure what your situation is exactly. But, if the house is in a trust now, then certainly it can be sold, but the proceeds would have to remain in the trust subject to the terms of the trust.

If your mother no longer needs Medicaid coverage, it can be refused, I imagine, and the family can provide for her itself, supplemented by the house proceeds.

However, this sounds like a decision that only should be made with the assistance of an elder law attorney familiar with the Medicaid rules who can review the trust terms and help the family make the best decision.
