Living trust and disabled children?

by Rick Klimowicz
(Somerset, NJ)

Hi,

I'm helping my Mom in planning her estate now and after death

A major question has arisen concerning both wills and living trusts. Both my brother and myself are disabled, both collecting SSD for most likely life.

What are the facts concerning my mother's estate after her death, precisely leaving her estate to us both with regards to the state and federal government.

A salesman has told my Mother because we (children) are disabled without a living trust we would not get any inheritance, and the state and federal would get it all and we would receive nothing. Is this true?

Any informaton regarding this would be appreciated.

Thank you

Rick

Why are you so concerned about inheriting your mother's money?? Her life and health are more important than "inheriting" her money. Maybe you could get a little part-time job?
