How Does Trustee Transfer Real Estate to Beneficiaries of Living Trust?

What are the steps a trustee must take to have real property (real estate) transfered into the heirs names of a living trust?


In other words what documents must be filled out and taken to the recorders office? where do you get the docs too be filled out?

Documents to Transfer Real Estate from Living Trust

Hi Chip,

Sorry, but the documents required to be filed in the county recorder (or property) office vary from jurisdiction to jurisdiction. Hopefully, the real estate was already properly transferred into the trust. If not, you might have go to probate court to make that happen.

But, assuming the property is in the trust, you may be able to simply go the recorder's office and obtain a form for the transfer. If that doesn't work, you will need to consult with a local living trust attorney.

I called the recording office they said that I needed to go on line fo a certain web site and fill out a new deed have it nortarized then bring it in. they will not tell me which form of deed I need to fill out I am very confused!!!
