Force a sale

I am co-trustee in an irrevocable trust. I have paid over $67.000.00 to him and about 15.00.00 in home restoration. The trust says we are both equal owners. Can I get this money back if we sell? He is now trying to force a sale.

Anything in writing?

Hi, is there anything in writing addressing this issue of what happens upon sale to investments each party made in the property? Perhaps there is some language in the trust? Maybe you all orally agreed to something -- hopefully with a witness present....

Just let me know whatever other facts are relevant. Thanks.

I will review the trust, the wording is confusing but what I get out of it is we are both 50% owners. At the time the verbal agreement was made to purchase his half of the home for $150.000.00 there were no witnesses, but once the annuity checks starting coming in they were immediately signed and put into his account. Big lumps of sum paid every year, property taxes and home owners insurance all paid by me. He had not put in one dime towards any up keep up the home or made any other payments (taxes, home ins.)As I was under the impression that all these payments were pursuant to my purchasing his half of this home. I would appreciate any other insight you can give. I will give more information and wording from the trust.

I'd say your course of conduct might support a contract, but what does he say? Have you asked him what he thinks should happen upon sale?
