Is it a conflict of interest if the attorney hired by a trustee, where the trustee is also a beneficiary of a trust.


Can this attorney give written advice to the grantor of the trust?

Hi, normally a trust will give the trustee power to hire an attorney to advise and act on behalf of the trust. Whether the trustee is also a beneficiary shouldn't affect that power/responsibility.

Of course, a trustee also has a duty to act in the best interests of the trust.
